Most states put a deadline on returning a deposit or sending an itemized statement, and several attach real consequences to missing it: losing the right to keep any deductions, or owing the tenant a multiple of the deposit. Landlords rarely miss the deadline on purpose. They miss it because nobody counted the days while contractors were still sending invoices.

Tell the tool how many days your state allows, how many have passed since move-out, and whether your statute allows doubled or tripled damages. It reports how many days you have left and the worst-case dollar exposure if the deadline slips: deductions you could forfeit, the statutory penalty, and any legal costs you enter. Deadlines and multipliers are inputs, not built-in assumptions, because they differ from state to state.

How to use this tool

  1. Look up your state's return deadline and what starts the clock, then enter the number of days and how many have already passed.
  2. Choose the damages multiplier your statute allows and enter the deductions you plan to claim plus any legal cost estimate.
  3. Use the days left to set an internal due date for the statement, and use the worst-case figure to decide whether waiting on one more invoice is worth the risk.

What the math assumes

  • The deadline length and the damages multiplier are whatever you enter; the tool contains no state-by-state table and does not know your statute.
  • Deductions at risk are capped at the deposit amount, since a forfeited deduction means returning deposit money you would otherwise have kept.
  • The statutory penalty is calculated as the deposit multiplied by one less than the multiplier you pick, so a 2x statute shows one extra deposit on top of the deposit itself.
  • Worst case assumes every possible consequence applies at once: forfeited deductions, the full multiplier, and the legal costs you entered. Courts often award less.
  • Days are counted as plain calendar days; the tool does not adjust for weekends, holidays, or mailing time.

Frequently asked questions

What happens if I send the statement one day late?

It depends on your state. Some treat any late statement as a forfeiture of all deductions, some require bad faith before penalties apply, and some have no penalty at all. The calculator shows the worst case so you can weigh the risk; your statute decides what actually applies.

Can I stop the clock by sending a partial refund?

Generally no. Most deadlines require the refund and the itemized statement together within the allowed period. If a repair quote is still pending, sending a good-faith estimate on time is usually safer than waiting for the final invoice.

Does the deadline start at move-out or when I get a forwarding address?

It varies by state, and some use whichever comes later. Count from the event your statute names, and if the tenant never gives you a forwarding address, follow your state's rule for mailing to the last known address.
